What is a Phase I Environmental Site Assessment?
A Phase I environmental site assessment report is generated as part of a commercial real estate (CRE) transaction, loan refinance, site audit, or to identify potential or existing environmental contamination liabilities. The Phase 1 ESA Report is usually among the first steps in the CRE process of environmental due diligence. a Phase 1 survey is the “Standards of Practices for All Appropriate Inquiries 40 code of federal regulations, section 312.” It is generally held that a lender, lessor, or buyer maybe responsible for clean-up of contaminated sites/properties even if the prior owner was cause for the issue.
Environmental Transaction Screens
An Environmental Transaction Screen (ETS) is a cost-effective solution to Environmental Due Diligence Reporting. An ETS is a scaled-down version of a Phase 1 commercial property inspection. An ETS environmental assessment includes regulatory records review, personnel interviews, and a site visit. It meets the guidelines set forth by the ASTM Standard Practice, but does not follow the EPA’s All Appropriate Inquiry (AAI) requirements and wil not offer the client protection from CERCLA Liability.
